everynote.com

Post by DaveF »

All,

I don't know whether the site http://www.everynote.com has been previously mentioned on this site, but I just happened to notice that they're selling editions of mine that are (of course) available free on this site. I can't believe I'm uniquely favoured by them, so there are probably a lot of other CPDL contributors' editions for sale there. The particular one I noticed was Byrd's Ave Verum - http://www.everynote.com/choral.show/129146.music - although, since this is an old version that has subsequently been revised, I'd have difficulty proving that. The other editions that look like mine (Terra tremuit, Dies sanctificatus) are even older. What's best to do:

a) A polite protest from me as a private individual;
b) A "corporate" approach from CPDL (perhaps after other contributors checking whether everynote.com are selling any of their editions);
c) Do nothing, given that many more choral singers have heard of CPDL than of everynote.com?

I'd be interested to know what others think.

Requiring proper credit to CPDL and our editors makes this case worth further pursuit and investigation. It looks to me as if that site is violating the terms of the CPDL license.

My copyright notices have indeed been removed from everynote's first pages although, as I said, the fact that these old editions have been revised out of existence on CPDL makes that situation a bit murky. A better example is Marton Jakobey's edition of Monteverdi's 4-part mass - our edition here: http://www2.cpdl.org/wiki/images/1/10/M4_complete.pdf and theirs here: http://everynote.com/goods.1/Mont_Ch_Mes4Voc_1.pdf - clearly exactly the same piece minus our copyright notice. I assume ours predates theirs.

Indeed it seems to be the same edition.
But, strangely enough, their document looks much more pixellized.
They must have imported the original in a (free) pdf editor, added their logo, and recreated a new pdf.
(I say "(free)" because I can't imagine the genuine Adobe suite producing such a low quality).

I've just read this on their site :
Can I redistribute the files derived from the EveryNote catalog?
No. Each digital score acquired and distributed by EveryNote, is the sole and exclusive property of EveryNote. Each score digitized by EveryNote has been copyrighted with the US Copyright Office and is under the international copyright protection. The EveryNote files are intended for your personal use. A few more "borrowings" I've come across:

Bruckner Locus iste = Brian Marble's edition (including the error in bar 8 - oops!)
http://everynote.com/goods.1/Bruc_Ch_LocIs.pdf

Monteverdi Lasciatemi morire = Mark Wenzel's edition
http://everynote.com/goods.1/Mont_Ch_lacMi.pdf

Taverner Christe Jesu, pastor bone = Dan Foster's
http://everynote.com/goods.1/Tave_Ch_ChJesu.pdf (including what is presumably Dan's reconstruction of missing baritone part!)

Weelkes As Vesta was = Frank van Nimwegen's (shocking quality in their edition; the Comic Sans font for the composer's name gives it away).
http://www.everynote.com/goods.1/Weel_Ch_AsVes.pdf

I also noticed a number of other editions on everynote that were identical to editions linked to CPDL - their 4 Croce pieces belong to marco-cipoo.net, and their Josquin Missa Pange Lingua is Dan Foster's, although linked to his site rather than hosted directly as with the Taverner piece.

PS - From the look of most of their other editions, I imagine most of them are just PD ones taken from IMSLP. Very shabby, isn't it?

A similar problem has been recently reported at IMSLP, related to copyrighted scores published at IMSLP but sold by somebody via eBay:

Has the "matter" been deep sixed? I see the above editions are still golden calves.
